Welcome to Lotus Aurea, a brand owned and operated by Lotus Aura LLC (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our website at lotusaurea.com and all related services, including the purchase of handwoven Indian sarees and handmade gemstone jewelry (collectively, the “Services”). By accessing our website or placing an order, you agree to be bound by these Terms.

Please read these Terms carefully before making a purchase. If you do not agree to these Terms, you may not use our Services.

1. Acceptance of Terms

By using the Lotus Aurea website, creating an account, or placing an order, you represent that you are at least 18 years of age, have the legal authority to enter into a binding agreement, and have read and accepted these Terms and our Privacy Policy.

2. Products & Artisan Craftsmanship

2.1 Nature of Our Products

All products sold by Lotus Aurea — including Banarasi, Chanderi, and Jaipuri sarees, as well as handmade gemstone jewelry — are artisan-crafted using traditional techniques. Each piece is unique and may exhibit minor natural variations in color, texture, weave pattern, or gemstone appearance that are intrinsic to handmade goods.

2.2 Color Accuracy

We take great care to photograph each product accurately. However, lighting conditions, camera equipment, monitor settings, screen calibration, and display brightness may cause the color shown online to appear slightly different from the actual product. These variations do not constitute a defect, misrepresentation, or grounds for a claim.

2.3 AI-Generated Imagery Disclosure

Some product images may feature AI-generated model imagery, disclosed in accordance with applicable AI Synthetic Performer Disclosure requirements. Actual garment appearance, fabric texture, and embroidery detail may differ from AI-rendered visuals.

3. Ordering & Payment

3.1 Order Placement

By placing an order, you are making an offer to purchase a product subject to these Terms. We reserve the right to accept or decline any order at our sole discretion. Orders are confirmed via email upon successful payment processing.

3.2 Pricing

All prices are listed in U.S. Dollars (USD) and are subject to change without notice. We reserve the right to cancel orders placed at incorrect prices.

3.3 Payment Methods

We accept major credit and debit cards and other payment methods displayed at checkout. By submitting payment information, you authorize us to charge the full order amount including applicable taxes and shipping fees.

3.4 Sales Tax

Applicable sales tax will be calculated and displayed at checkout based on your shipping address and applicable tax laws.

4. Shipping & Delivery

4.1 Processing Time

Orders are typically processed within 2–4 business days. You will receive a shipping confirmation email with tracking information once dispatched.

4.2 Domestic Shipping

We ship within the United States. Standard shipping timelines are 5–10 business days from dispatch. Expedited options may be available at checkout.

4.3 International Shipping

We offer international shipping to select countries. Customs duties, import taxes, and local fees are the sole responsibility of the recipient.

4.4 Risk of Loss

Risk of loss and title pass to you upon delivery to the carrier. We are not responsible for packages lost or damaged in transit, but will make reasonable efforts to assist in resolving carrier disputes.

5. All Sales Final

ALL SALES ARE FINAL. We do not accept returns, exchanges, or cancellations once an order has been placed and confirmed.

5.1 Nature of Handcrafted Goods — Not a Defect

Natural variations in weave, color, texture, embroidery, and gemstone inclusions are inherent to handmade artisan goods and do not constitute damage, defect, or grounds for a claim.

5.2 Exceptions

  • Severe damage in transit: Due to carrier mishandling. Natural artisan imperfections do not qualify.
  • Wrong item received: A product materially different from what you ordered.

Contact support@lotusaurea.com within 48 hours of delivery with your order number and photographs. We will offer a replacement or store credit at our sole discretion.

6. User Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. We reserve the right to suspend accounts that violate these Terms or engage in fraudulent activity.

7. Intellectual Property

All content on the Lotus Aurea website is the exclusive property of Lotus Aura LLC and is protected by applicable copyright, trademark, and intellectual property laws. You may not reproduce or distribute any content without our prior written consent.

8. Prohibited Conduct

  • Violate any applicable law or regulation
  • Submit false or fraudulent orders or payment information
  • Use automated tools, bots, or scrapers to access our site
  • Attempt to circumvent security features
  • Impersonate Lotus Aurea or any of its representatives

9. Disclaimer of Warranties

THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LOTUS AURA LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Lotus Aura LLC, operating as Lotus Aurea, and its owners, employees, and agents from any claims or expenses arising from your use of our Services or violation of these Terms.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Virginia. Disputes not resolved informally within 30 days shall be submitted to binding arbitration in Loudoun County, Virginia.

13. Privacy Policy

Your use of our Services is governed by our Privacy Policy, incorporated into these Terms by reference.

14. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be posted with an updated effective date. Continued use of our Services constitutes acceptance.
